Remember, when reading this, that it was written by an attorney, as an attorney's view.

Joseph Story's writings should also be considered [being from the same time period] along with the federalist papers and the anti-federalist papers. The Expose' Volumes address these aspects in a different light, and in great depth.


Rawle's - A View of the Constitution


Here lay the links to Rawle's A View of the Constitution, 1829 version 2nd Edition.

He attempts, with his treatise, to present his views on the document now referred to as "The Constitution of The United States of America". The original document carried no title or label, save for it's "preamble"[statement of: reason for creation; and, ruling law].

It was, in the purist and correct contractual form, a binding agreement between: the Peoples of America; and, those whom they knew would be drawn to the positions they were creating with this document, to control them. Remember though, when reviewing this document, he was a lawyer, precursor of modern day "attorneys".

We must never ignore the FACT, that the founders; drawing up, considering, and ultimately ratifying the document for presentation to the People of the several states, were "experts" at common law "contractual agreements".

NOTE SPECIFICALLY: this "Constitution" is NOT "United States Constitution" or "Constitution of the United States" as so referred to by "Congress", the "courts", and government in present legislated law and judicial "ramblings".
That "theory"/"concept" [based and styled upon Roman/English law and parliament] was created by "congress and those who control" well after the actual historical document, which now allows government to "do as it pleases", like the British parliament of "Old", as if the contract is just a "piece of paper".

Moreover, we must always understand the FACT, that what now passes for "normal government actions" were originally, and accurately seen as prohibited, "tyranical", or worse.
