Liability links


Individuals are always concerned with apparent misconduct, misfeasance, non-feasance, malfeasance, police abuse, and other issues which appear in various cases or activities in America.


FIRST, these are not the only available liability materials concerning these activities.


SECOND, though many cites appear to be applicable to potential activities which might be under research or investigation, these are NOT the final statements concerning those issues. These were created in the courts by the special circumstances of the exact matters before the court.

That does NOT mean these are the final statements concerning those matters, but where it stands now, where it stood then, or where it stood pursuant the "particulars" of that case. Should new attacks (issues, materials, or evidence) be presented, these MAY change.


THIRDLY, if you intend to use these liability materials, then read the entire "official" published versions of the rulings BEFORE citing the case. These are not the "official published versions". The reason is apparent; if the citation is immaterial to the case at hand, and it is presented instead of the proper citation(s), nothing of value is presented to the court to review.

Moreover, when counter citations are presented, you will not understand the full import of those citations, and be unable to properly respond.

There are 'summaries' available, but even those may not interpret the case properly. Those who write these can make mistakes or misinterpret, or miss important aspects within those cases.


FOURTHLY, always remember that "no one is above the Law". Check the state and national statutes for the applicable law, before you attempt to proceed. Though civil liability may have been granted for some, criminal liability is beyond the capacity of congress, the executive, and the courts to grant immunity to anyone, save (unless) for "truthful" testimony/evidence. The constitution precludes absolute immunities for unlawful, illegal, or criminal acts and/or activities.

This is, of course, "qualified". Partial immunities may be granted if it is necessary to a criminal prosecution (say for a conspiracy), and does not allow that party granted immunity from prosecution for unlawful or criminal activities: before; pursuant; in; the court or grand jury or other "special" proceeding (such as congressional inquiry).

Even here there may be "special considerations", such as lying to a grand jury reviewing conspiracy, then turning "evidence" against fellow conspirators.

It goes much deeper, but there are numerous Law books and other, which deal with these "variables", therefore, it can not be stated with finality here, that immunity is not allowed.
