Motion to transfer state matter(s) to this court was duly filed in this court on November 20, 2003 by Maurice Edward, Brahier (plaintiff-petitioner). Defendant parties were afforded opportunity to be heard and or benefit of discussion, none was presented, no opposition to transfer was presented. Plaintiff/Petitioner, Maurice Edward, Brahier, in his presents to this court, suggests that 12 years of unlawful and or illegal and or criminal activities have occurred. He also presents that these issues are in the state records. He has also indicated that the State of Ohio's parties of responsibility and duty were properly notified over the course of apparently twelve years from 1991-2003 with complaints and or requests for investigation and or otherwise. He indicates, that all present judges and or magistrate(s) of the state court from which the transfer is requested, have been and or are implicated in this unlawful and or illegal and or criminal activity. The Plaintiff/Petitioner, moreover, suggests that there is no adequate remedy available within Ohio as even it's Supreme Court has been contacted, and has apparently participated. Upon reviewing this courts own records, it is found, that the various defendant parties have been contacted over the course of years. Federal complaints have been filed, requests for investigation and other have been tendered to the proper parties at the state and federal level. Plaintiff has submitted a computer copy of one such additional contact with his Motions. Plaintiff/Petitioner Maurice Edward, Brahier has submitted request to proceed in forma pauperous, with costs or fees and other held or recovered. The request is granted. All costs as might apply to the plaintiff concerning this case shall be supplied by this court pending recovery. Wherefore, for good cause shown, the state matter is hereby ordered transferred to this court for review of recovery of damages, costs, fees, and other as might apply or be found by this court. Furthermore, the clerks of court of the Ohio and Kentucky actions are ordered to supply this court with the full and complete records of the cases concerning Maurice Edward, Brahier. They shall, additionally, supply Maurice Edward, Brahier with certified docketing statements and listings of documents in chronological order so he might review them for completeness of records. Additionally, order is issued to the U.S. Attorney General's office to review these records for possible criminal prosecution of the defendants. Orders of seizure (freezing assets and other) shall be issued against these party defendants by the clerk(s) of this court, to ensure that recovery might be obtained. Moreover, the Internal Revenue Service shall be advised to review the defendant parties prior tax histories. The I.R.S. will also supply this court with prior tax statements/returns filed by the defendants so the court might ensure that all defendant parties assets and other, are reviewable and available for any recovery this court might order. Relief from this courts rulings/judgments Plaintiff/Petitioner Maurice Edward, Brahier has also requested relief from the orders/judgments issued by this court in his various actions filed herein. This court apparently proceeded under the assumption that the state proceedings were done in good faith, with proper jurisdiction, and otherwise complying with the letter and rule of law. However, Maurice Edward, Brahier has been successful in his removal of the base case in Ohio, leaving this court's rulings without basis in law and or otherwise having no foundation available to them. The rulings are voided as is required. Moreover, the original federal case 5:94-CV-00035 received no opposition, refute or otherwise from those defendant parties. Having been afforded benefit of discussion and opportunity to be heard, the defendant parties of that action waived right of defense. Judgment is entered accordingly, for the plaintiff, Maurice Edward, Brahier. This judgment may be used as basis for the seizure of assets and other of those defendant parties. This is a final appeallable Order pursuant that case.
