Now comes the defendant-appellant after being first duly 
 
sworn according to law and states: 
 
1. he is the defendant-appellant in the case. 
 
2. he has not had time to properly prepare the case for the 
 
court because: 
 
   (a) he just found the proper presentation procedures for 
 
presentation to the Court of Appeals. 
 
   (b) he does not have representation to prepare the case 
 
for presentation, not by choise but by chance. 
 
   (c) he is not in the area of the court records to comply 
 
with the rule to include referances to text. 
 
   (d) if the court will not waive the rule, he requests that 
 
he be given a extended period of time to file his brief so 
 
that he may obtain the funds necessary to obtain the record 
 
for use in the area in which he has been forced to reside. 
 
 I request that this take effect immediately, so that I can 
 
protect my right to appeal.   
 
 I state that I have no other adequate remedy at law. 
 
 Affiant further sayeth naught.
